Testing brought to concern with Girl Talk All Day

The second album by Pittsburgh DJ Girl Talk has been launched. This record is named “All Day”. Girl Talk built 71 minutes of music with 373 music samples. Girl Talk “All Day” is being released for free and will likely spark further discussion of the legality of testing.

A second album was released by DJ Girl Talk, or Greg Gillis. In 2008, he released his first record while since then more than 40 tour dates a year have been scheduled. On the Illegal Art website, you are able to get a totally free download of "All Day". It will take you 71 minutes to listen to Girl Talk's "All Day" all the way through. It is supposed to be one long listening piece even though there are technically 12 tracks on it. On the record, you will find about 373 different samples or pieces of songs from the artists.

The lawful issues of sampling for ‘All Day’

There are lawful problems with sampling the Girl Talk "All Day" record. In general, with permission, trying of music for a new piece is allowed. Sometimes individuals won't get permission first. This means the courts have had to deal with the "fair use" of music samples a lot. Recently there was a decision made with Bridgeport Music Inc. v. Dimension Films. This decision said that a "distinctive" three note riff is enough if permission wasn't requested to be considered a violation.

'All Day' by Girl Talk and how Innovative Common permit does apply

As a backlash to the all-or-nothing copyright option, there has been a growing use of the Creative Commons permit. Artists are allowed to "claim and release" with the copyrighting meaning that their work can be remixed and used for commercial purposes with their permission. Releasing the Girl Talk "All Day" album was ok due to a license like this. A Creative Commons non-commercial permit is used here. This means that everyone has permission to use the work, as long as it’s not for commercial reasons. There’s a question of whether Girl Talk needs to be paid for the work although it may be good for Girl Talk to be exposed with this.
